ADA Title III

Title III of the Americans with Disabilities Act prohibits discrimination on the basis of disability in places of public accommodation. Federal courts have consistently applied Title III to public-facing websites — making digital accessibility a legal requirement, not a nice-to-have.

Who It Applies To

PRACTICAL REQUIREMENTS

  • Public-facing website conforms to WCAG 2.1 Level AA
  • Accessible navigation usable with keyboard and screen reader
  • Alt text on all informative images
  • Captions on all pre-recorded video
  • Forms with proper labels and error handling
  • Color contrast meeting 4.5:1 minimum for text
  • Published Accessibility Statement with contact info
  • Process to respond to accessibility complaints in good faith
  • Third-party content (chatbots, embeds) also accessible
  • PDFs and downloadable docs tagged and accessible
